Introduction

These Terms and Conditions constitute the legal agreement between users of the Wesal Gate platform (“User,” “Merchant,” “Supplier,” “Importer,” “Company,” “Individual,” or any legally represented entity) and Wesal Gate. By using the platform, you fully agree to comply with these terms. If you do not agree with any provision, please refrain from using the platform.

Eligibility for Use

The services of WesselGate are limited to businesses, organizations, and individuals who are legally authorized to conduct commercial activities and financial transactions in their respective countries in accordance with applicable regulations and official laws. Any unauthorized entity is prohibited from conducting commercial or financial transactions through the platform. If a user is under the age of 16, they must be represented by a legal guardian in accordance with applicable laws

Account Verification and Information

WessalGate is committed to verifying the identity of suppliers before allowing them to be listed on the platform. All users must provide accurate and up-to-date information. The platform reserves the right to request additional documents, such as identity proof, official licenses, invoices, delivery receipts, and any other necessary documents to ensure compliance and security. Failure to provide the required information may result in account suspension or termination. 

Updating Business Information

Users agree to notify WessalGate of any significant changes, such as changes in business activities, products, ownership, contact details, production capacity, distribution areas, or any other factors affecting their evaluation on the platform. Failure to update information may result in account restrictions or termination.

Payments

All payments must be processed exclusively through the WesselGate platform. Funds will be held until the importer confirms receipt of the goods according to the agreed terms. External financial transactions outside the platform are strictly prohibited to ensure security and transparency. 

Shipping and Delivery

After payment, the importer can choose from the following shipping options:  

  • Direct shipping from the supplier if they offer shipping services.
  • Utilizing certified shipping companies available on the platform, where shipping quotes from local and international logistics providers can be requested.
  • Tracking shipments directly from the dashboard to monitor the order status.

WesselGate is not responsible for any delays or damages occurring during shipping if the importer chooses direct shipping from the supplier. The importer is responsible for ensuring compliance with customs regulations in their country. WessalGate is not liable for any customs duties or regulatory restrictions affecting the clearance of the shipment.

Disputes and Conflict Resolution

In the event of a dispute between a supplier and an importer, the platform provides a dispute resolution mechanism as follows:

  1. Direct communication between the supplier and importer to resolve the issue within a specified period.
  2. If no resolution is reached, a formal complaint may be submitted to WessalGate, which will review the matter and take appropriate action.
  3. If the dispute persists, an independent arbitration body or the competent judicial authorities in Saudi Arabia may be involved.

WessalGate is not legally responsible for any direct or indirect losses resulting from disputes between parties.

Privacy Policy and Confidentiality

WessalGate is committed to maintaining the confidentiality of users’ personal, business, and financial information. Data will not be disclosed to third parties except in cases required by law, upon obtaining explicit user consent, or when sharing certain information with authorized service partners is necessary to ensure efficient service delivery.

Payment Settlements and Refund Process

All payments are processed within the platform through authorized payment systems. Payments to suppliers will only be released after the importer confirms receipt of the goods as per the agreed conditions.

If the goods are not received or are received in a non-compliant condition, the importer has the right to request a refund in accordance with platform policies. Refund requests are subject to review and may take time depending on the nature of the complaint. Refunds will be processed using the original payment method, and banking or administrative fees may apply based on the service provider’s policies.

Governing Law and Jurisdiction

This agreement is governed by the laws of Saudi Arabia. Any legal dispute between the user and WessalGate will be settled in accordance with Saudi regulations. The courts of Saudi Arabia shall have jurisdiction over any disputes arising from these terms.

Complaints and Communication

WessalGate is committed to handling user complaints fairly and promptly through official channels, including the website, application, or email. Users will be kept informed of their complaint status within the specified timeframe. 

WessalGate may update these terms from time to time, and users will be notified of any changes via email or platform notifications. Continued use of the platform after such updates constitutes acceptance of the revised terms.
